Terms of Use

These terms apply to StackJack 2.0 and later and to this website. They take effect when StackJack 2.0 is released on the App Store.

1. Who we are and what these terms cover

StackJack (the "App") and stackjack.app (the "Site") are provided by Lost Island Entertainment, Inc., a Wyoming corporation ("Lost Island", "we", "us"). By downloading or playing the App or using the Site, you agree to these terms. Our Privacy Policy explains how we handle data.

2. Your licence to the App

The App is licensed, not sold. Your licence is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), and these terms add to it. If these terms and the Standard EULA conflict, the Standard EULA controls as between you and Apple.

You acknowledge that:

• these terms are between you and Lost Island only, not Apple, and Lost Island — not Apple — is solely responsible for the App and its content;
• Apple has no obligation to provide maintenance or support for the App;
• if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the App;
• Lost Island, not Apple, is responsible for any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims;
• Lost Island, not Apple, is responsible for investigating, defending, settling and discharging any claim that the App infringes a third party's intellectual property rights;
• you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

3. Who can play

StackJack is designed for players aged 13 and older. If you're under the age of majority where you live, please review these terms with a parent or guardian, who is responsible for your use of the App and any purchases. Parents can find guidance on our page for families.

4. Purchases

• StackJack Plus and Plus Collector's are one-time, non-consumable purchases. Plus removes ads shown between games and adds the extras listed in the App; Collector's adds the cosmetics and supporter badge listed in the App. Rewarded ads remain available as an optional choice.
• Purchases are processed by Apple under its terms. Prices are shown in the App Store in your local currency and may include taxes. Refund requests are handled by Apple at reportaproblem.apple.com.
• Purchases are tied to your Apple Account, work on iPhone, iPad and Mac, support Family Sharing, and can be restored at any time from Shop › Restore purchases.
• If you bought the original paid StackJack, StackJack Plus is included at no charge on the same Apple Account.
• If we ever add ads, Plus will continue to remove ads shown between games for as long as we offer the App.

5. Atoms and cosmetic items

Atoms are an in-game currency you earn by playing, and cosmetics are visual items such as card backs and tables. Atoms and cosmetics have no monetary value, can't be bought with or exchanged for money, can't be transferred or sold, and are a limited licence to use them in the App. They never give a gameplay advantage in ranked play. We may rebalance how Atoms are earned or spent, but we won't remove cosmetics you've unlocked except as required by law or to fix an error.

6. No gambling

StackJack is a game of skill and speed played for fun. It has no betting, no wagering, no stakes, no prizes and no real-money play, and nothing in the App can be redeemed for money or anything of value.

7. Fair play, leaderboards and Duels

• Don't cheat, exploit bugs, modify the App, use automation or interfere with other players' games or with leaderboards.
• Leaderboards are run by Apple Game Center. We may ask Apple to remove scores that appear manipulated, and we may report achievements and scores only from unmodified versions of the App.
• Duels connect only with nearby devices on the same local network. Only play with people you know.
• Choose a Game Center nickname and device name that are not offensive or misleading.

8. Feedback

If you send us feedback or ideas, you allow us to use them to improve StackJack without paying you or owing you anything. Please don't send anything confidential, and don't include other people's personal information.

9. Our intellectual property

StackJack, its name, logo, artwork, characters, music, sounds, text and software belong to Lost Island or its licensors and are protected by law. Apart from your licence to play and the right to share challenge codes and share images from the App, these terms don't give you any rights in them. You may share screenshots and videos of your own play for non-commercial purposes; streamers and video creators are welcome to monetize gameplay videos that include original commentary.

10. The website

You may browse the Site and download the press kit for news, reviews and editorial coverage of StackJack. Don't misuse the Site — for example, by trying to disrupt it, probe it for vulnerabilities without permission, or scrape it at a rate that burdens it. Links to other sites, such as lostisland.com and the App Store, are governed by their own terms.

11. Changes to the App and these terms

We may update the App — adding, changing or retiring modes and features — and we may update these terms. If we make a material change to these terms, we'll update the date above and, where appropriate, tell you in the App before it takes effect. Continuing to play after a change takes effect means you accept it; if you don't, please stop using the App. Changes don't apply retroactively.

12. Disclaimers

To the extent the law allows, the App and Site are provided "as is" and "as available", without warranties of any kind beyond those that can't be excluded by law. We don't guarantee that the App will be uninterrupted or error-free, that Game Center or other Apple services will be available, or that leaderboard positions or progress will be preserved if your device is lost or reset without a backup.

13. Limitation of liability

To the extent the law allows, Lost Island will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from the App or Site; and our total liability for any claim relating to them will not exceed the greater of the amount you paid us for the App and in-app purchases in the 12 months before the claim, or US$50. Some jurisdictions don't allow these limits, so they may not apply to you. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.

14. Your rights as a consumer

If you are a consumer, nothing in these terms affects the rights you have under the mandatory consumer protection laws of the country where you live, including any statutory guarantees and rights regarding digital content. Where those laws give you a right to withdraw from a purchase of digital content, that right ends when the content is delivered with your consent; refunds for App Store purchases are requested through Apple.

15. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise. Please contact us first at legal@stackjack.app so we can try to resolve any problem informally. Either of us may bring a claim in small claims court, and you may bring proceedings in the courts where you live if your local law gives you that right.

16. General

If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a term isn't a waiver. You may not transfer these terms; we may transfer them to a successor that continues to offer the App. These terms, the Standard EULA and our Privacy Policy are the entire agreement between you and us about StackJack.
